Legana is committed to protecting the privacy and personal information of its employees and customers, however that information has been provided.

Privacy commitment

This Privacy Policy explains how Legana Facility Services Pty Ltd (ABN 82 697 153 898) and its related entities comply with the Privacy Act 1988 (Cth) (the Act) in relation to the collection, storage, use and disclosure of personal information of individuals. While we endeavour to uphold the same principles throughout, this policy does not apply to personal information collected by Legana that is exempted under the Act.

What personal information we collect

Information collected by Legana is used for the purpose for which it was primarily collected. The information we may collect about you includes:

  • name, date of birth, address and gender;
  • credit and debit card details;
  • banking and financial details;
  • tax file numbers and other government-issued identification numbers, including visa status;
  • information in identification documents (for example passport, driver licence, Medicare card);
  • health information;
  • next of kin and power of attorney details; and
  • other information Legana considers necessary to provide its services.

In some circumstances it may be necessary to collect sensitive information about you in order to provide specific services or for recruitment purposes. Examples include professional memberships, ethnic origin, criminal record and health information.

Why we collect personal information

Legana only collects personal information about you that is necessary for its legitimate business functions or activities (the primary purpose). These may include:

  • providing facility services such as routine cleaning and hygiene, remote village solutions, and grounds and waste management;
  • administering and managing those services, including charging, billing and collecting debts;
  • recruitment of employees or contractors;
  • informing you of our products and services that we believe may be of interest to you; and
  • engaging service providers, suppliers or contractors.

In collecting personal information, we will act lawfully and fairly.

You may choose not to provide us with information. However, if we are not provided with personal information, we may be unable to provide you with employment, contract work, services or information.

How we collect personal information

Legana may collect personal information from you directly during telephone calls with our representatives, through your use of our website, on forms and other correspondence you send to us (including email, text, facsimile and letter), and when we deliver services. We may also collect personal information about you from third parties, for example Legana clients.

Legana will take all reasonable steps to ensure that the personal information we collect, use or disclose is accurate, and to correct any inaccurate personal information of which we are made aware.

Use and disclosure

Generally, Legana will only use and disclose your personal information for the purpose for which it was collected. We may use and disclose your personal information for another purpose if you have consented, or if the secondary purpose is related to the primary purpose and might reasonably be expected by you. Examples of recipients include our clients, related entities, third party service providers, and background screening providers for the purpose of obtaining clearances.

Personal information may also be disclosed in special situations where we have reason to believe that doing so is necessary to identify, contact or bring legal action against anyone damaging, injuring or interfering (intentionally or unintentionally) with our rights or property, our users, or anyone else who could be harmed by such activities.

Access and correction

You can request access to the personal information we hold about you, subject to some limited exceptions allowed by law. Such requests must be made in writing, and we may charge reasonable costs for providing access.

If you believe that any personal information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, you may request correction using the contact details below. We will take reasonable steps to correct it in accordance with the Act.

This website

By using Legana's website you agree to this Privacy Policy, including the collection and use of personal information you supply to us through your conduct on the website. This policy is in addition to any other terms and conditions applicable to the website. When you use www.leganafs.com.au:

  • Enquiry form. If you submit an enquiry, we collect your name, organisation, email address, phone number and the details you provide, and use them only to respond to your enquiry and follow up about the services you asked about. Enquiries are processed by a Microsoft Azure function hosted in Australia and delivered by email to our enquiries inbox.
  • Technical logs. Our hosting records standard technical information about each visit, such as IP address, browser type and the pages requested, which we use to keep the site secure and diagnose problems. These logs are kept for a short period (around 30 days) and are not used to identify you.
  • No accounts. The website has no user accounts or logins.

We do not sell personal information, and we do not use enquiry-form details for marketing without your consent.

Cookies and analytics

With your consent, we use Google Analytics 4 to understand how visitors use the site, for example which pages are viewed and where visitors arrive from. Google Analytics is only loaded if you select "Accept" on the cookie notice. If you decline, or do not respond to the notice, it is not loaded and no analytics cookies are set.

When enabled, Google Analytics sets cookies (named _ga and _ga_*) and collects information including the pages you view, your approximate location (derived from your IP address - Google does not report your full IP address to us), your device and browser type, and the site that referred you. This information is processed by Google on our behalf and may be stored on servers outside Australia, including in the United States.

You can:

  • select "Decline" on the cookie notice, or change your mind later by clearing this site's data in your browser, which removes the saved choice and shows the notice again;
  • install the Google Analytics opt-out browser add-on (tools.google.com/dlpage/gaoptout); or
  • use your browser's private-browsing mode or cookie controls.

The site sets no other cookies.

Links to other sites

We provide links to websites outside our own, including third party websites. These linked sites are not under our control, and we cannot accept responsibility for the conduct of the companies operating them. Before disclosing your personal information on any other website, we advise you to examine that website's terms and conditions and its privacy statement.

Storage and security

We strive to ensure the security, integrity and privacy of personal information submitted to our sites, and we review and update our security measures in line with current technology. Unfortunately, no data transmission can be guaranteed to be totally secure.

Legana stores personal information in different ways, including in paper and electronic form. We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These measures include physical measures such as storing files in lockable cabinets, and technological measures such as access restrictions, firewalls and passwords. We also maintain document retention policies and processes.

Data breaches

Legana manages suspected or actual data breaches in accordance with applicable privacy requirements. Where a breach involving personal information is likely to result in serious harm and meets the requirements of the Notifiable Data Breaches scheme, Legana will notify affected individuals and the Office of the Australian Information Commissioner as required by law.

If you wish to lodge a complaint, please provide your contact details and information about the complaint. We may contact you to obtain further information. In accordance with our complaints handling procedure, we will investigate the complaint and provide you with the outcome as quickly as possible.
